Tancar-se en un espai de l\u2019empresa, abandonar les funcions assignades i desatendre el lloc de treball suposa una vulneraci\u00f3 de la bona fe contractual i pot considerar-se una falta molt greu. Aquest \u00e9s el fonament pel qual el TSJC ha declarat procedent l\u2019acomiadament.<\/p>\n<p>La sent\u00e8ncia detalla, a m\u00e9s, que els dos empleats es van absentar de les seves tasques durant un per\u00edode prolongat. \u00a0A m\u00e9s \u00a0es van refugiar en una caseta de manteniment sense justificaci\u00f3. Aquest abandonament del lloc de treball, subratlla Vidal, \u00e9s l\u2019element que legalment sost\u00e9 la decisi\u00f3 empresarial i que evidencia una clara ruptura de confian\u00e7a.<\/p>\n<p>&nbsp;<\/p>\n<h3><strong>L\u00edmits i obligacions dins del marc laboral<\/strong><\/h3>\n<p>En qualsevol contracte de treball, les empreses tenen dret a exigir que els empleats compleixin les seves funcions i actu\u00efn d\u2019acord amb els principis de responsabilitat, professionalitat i disponibilitat.<strong> Qualsevol conducta que impliqui deixar de prestar servei sense causa<\/strong> \u2014ja sigui per pr\u00e0ctiques inapropiades, pauses excessives o desconnexi\u00f3 injustificada\u2014 <strong>pot derivar en sancions disciplin\u00e0ries<\/strong>, incl\u00f2s l\u2019acomiadament.<\/p>\n<p>Des de RISK XXI, especialistes en Prevenci\u00f3 de Riscos Laborals, recordem que la bona fe contractual forma part del nucli essencial de tota relaci\u00f3 laboral.
